These Terms of Use ("Terms") govern your access to and use of FinTarget, a personal finance tracking platform operated at fintarget.app ("FinTarget", "we", "us", "our").

By creating an account or using FinTarget, you agree to be bound by these Terms. If you do not agree, you must not use the platform.

You must be at least 18 years of age to use FinTarget. By using the platform, you represent and warrant that you meet this requirement.

We reserve the right to update or modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the platform. Your continued use of FinTarget after changes are posted constitutes your acceptance of the revised Terms.

By using FinTarget, you agree to:

Lawful use — use the platform only for lawful purposes and in accordance with these Terms. You must not use FinTarget in any way that violates applicable Australian or international laws or regulations.

Accurate information — provide accurate, current, and complete information when creating your account and keep it up to date.

One account per user — maintain only one account. You must not create multiple accounts or share your account with others.

Account security — keep your login credentials confidential and notify us immediately at hello@fintarget.app if you suspect unauthorised access to your account. You are responsible for all activity that occurs under your account.

No misuse — not attempt to gain unauthorised access to any part of the platform, its related systems, or networks. You must not introduce malware, viruses, or other harmful code.

Data accuracy — independently verify the accuracy of any financial data, stock prices, or calculations provided by the platform before making any financial decisions. FinTarget is a tracking tool, not a financial advisory service.

Personal use — use FinTarget solely for your own personal financial tracking purposes, not for commercial resale or redistribution.

FinTarget commits to the following:

Privacy — handling your personal information in accordance with our Privacy Policy, available at fintarget.app/privacy.

Security — using industry-standard encryption (HTTPS/TLS) for all data transmitted to and from the platform. Passwords are hashed and never stored in plain text. Row-level security ensures your financial data is accessible only to you.

Availability — we aim to maintain high platform availability, however we do not guarantee uninterrupted access. Scheduled maintenance and unforeseen outages may occur. We will endeavour to provide advance notice of planned downtime.

Data backups — we maintain regular backups of platform data. However, we do not guarantee zero data loss and recommend you maintain your own records of important financial information.

Notifications — notifying you of material changes to these Terms, our Privacy Policy, or our pricing with reasonable advance notice.

Trial period — FinTarget offers a 7-day trial for a one-time fee of $1.99 AUD. This fee is charged at the time of sign-up and is non-refundable. The trial gives you full access to all platform features for 7 days.

Monthly subscription — after the trial period, continued access requires a monthly subscription of $9.99 AUD per month. Your subscription will automatically renew each month unless cancelled.

GST — all prices are in Australian Dollars (AUD) and include GST where applicable.

Payment processing — payment card details are encrypted and processed by our third-party payment provider. We do not store your full card details on our servers.

Upgrades and changes — if we introduce new subscription tiers in the future, you will be notified in advance with the option to choose your preferred plan.

Failed payments — if a payment fails, we will notify you and provide a grace period to update your payment details. Continued failure to pay may result in suspension or termination of your account.

No refunds — all fees paid to FinTarget are strictly non-refundable. This includes the $1.99 AUD trial fee and any monthly subscription fees. We do not offer refunds under any circumstances, including cancellation, non-use, or dissatisfaction with the service.

Cancellation — you may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.

All content, features, functionality, design, code, and materials on the FinTarget platform are owned by FinTarget and are protected by Australian and international intellectual property laws.

You may not reproduce, distribute, modify, adapt, publicly display, or create derivative works from any part of the platform without our prior written consent, except for your own personal use within the platform.

You retain ownership of all financial data you enter into FinTarget. By entering data into the platform, you grant us a limited licence to store, process, and display that data solely for the purpose of providing the service to you.

FinTarget integrates with third-party services to provide certain features, including:

- Supabase for database and authentication infrastructure - Vercel for platform hosting - Resend for transactional email delivery - Yahoo Finance for real-time and historical stock price data

We are not responsible for the availability, accuracy, or practices of these third-party services. Their use is subject to their own terms and privacy policies.

The platform may contain links to external websites. These links are provided for convenience only. We have no control over external sites and accept no responsibility for their content or practices.

No financial advice — FinTarget is a personal finance tracking tool only. Nothing on the platform constitutes financial, investment, tax, or legal advice. You should consult a qualified professional before making any financial decisions.

No warranty — the platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be error-free, uninterrupted, or free of viruses or other harmful components.

Data accuracy — stock prices, portfolio valuations, and other financial data are sourced from third parties and may not always be accurate, complete, or current. You rely on this data at your own risk.

Limitation of liability — to the maximum extent permitted by law, FinTarget's total liability to you for any claims arising from your use of the platform is limited to the total fees you have paid to us in the 12 months preceding the claim. All fees are non-refundable and no exceptions will be made.

Exclusion of consequential loss — we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the platform.

Indemnification — you agree to indemnify and hold FinTarget harmless from any claims, losses, damages, or expenses (including legal fees) arising from your breach of these Terms or your use of the platform.

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law that cannot be excluded, restricted, or modified.

Termination by us — we may suspend or terminate your account immediately and without notice if you breach these Terms, engage in fraudulent activity, or if required by law.

Termination by you — you may cancel your account at any time by contacting us at hello@fintarget.app or through your account settings. Cancellation takes effect at the end of your current billing period.

Effect of termination — upon termination, your right to access the platform ceases immediately. We will delete your account data within 30 days of termination, except where we are required to retain it by law.

No recovery — once your account is deleted, your data cannot be recovered. We recommend you export any important data before cancelling.

If a dispute arises between you and FinTarget, both parties agree to first attempt to resolve the matter in good faith through direct communication. Please contact us at hello@fintarget.app with a description of your concern.

If a dispute cannot be resolved informally, it shall be submitted to mediation before either party initiates legal proceedings.

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria for the resolution of any disputes.

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FinTarget regarding your use of the platform and supersede all prior agreements and understandings.
